What is a K-1 Visa?

Required Documentation For K-1 Visa

Form I-129F Petition

The U.S. citizen fiancé/anticipated spouse must file an I-129F Petition to the U.S. Citizenship and Immigration Services (USCIS). The petition must also include required supporting documents listed below to prove the legitimacy of the relationship between you and your fiancé, requiring that the couple met in person within two years of filing the petition. Required supporting documents for the I-129F include:

  1. Form I-129F, the petition for the Nonimmigrant Fiancé(e).
  2. Proof of U.S. Citizenship. This includes a valid passport, birth certificate, or naturalization certificate.
  3. Evidence of legitimate relationship. Evidence can include photographs of the couple with timestamps of when photos were taken, proof of travels together, correspondence together, etc.
  4. A written statement of intent to get married. This letter is signed by both the petitioner and the beneficiary stating intent to marry within 90 days of entry. 
  5. Divorce or death certificate(s) for any previous spouse(s) for both fiancés
  6. One passport size photograph of yourself and one passport size photograph of both you as the petitioner and your fiancé(e) as the beneficiary. These are typically 2-inch-by-2-inch photographs. 

Once the I-129F petition is approved by USCIS, it is then forwarded to the National Visa Center (NVC) to have the petition processed. Once that is complete, the petition will be sent to the appropriate U.S. embassy or consulate in the beneficiary/fiancé(e)’s country. It is then the fiancé(e)’s turn to gather their necessary documents. 

After filing an I-129F Petition, some documents that may be required of the beneficiary to apply for a K-1 visa include:

  1. Form DS-160, the Online Nonimmigrant Visa Application. Nonimmigrant visa applicants to the United States MUST complete Form DS-160 through the Department of State’s website. 

  2. A Valid Passport with at least 6 months remaining before the passport’s expiration date.
  3. A copy of your foreign fiancé(e)’s passport
  4. Two passport-style photos
  5. Additional Evidence of Relationship. This consists of photos of the couple together, messages between the couple, etc. 
  6. Police Clearance Certificate. This is required from all countries where the beneficiary has lived for six months or more since age 16. 
  7. Evidence of financial support, Form I-134.
  8. Medical examination records from an embassy-approved physician.
  9. Divorce or death certificate(s) for any previous spouse(s) for both fiancés (if applicable, to verify the couple’s eligibility to marry)
  10. Visa Fee Payment Receipt (if applicable)

Preparing for the K-1 Visa Interview

Once documents have been gathered, the next step in the K-1 Fiancé(e) Visa Application process is the K1 Visa interview. The interview is a crucial step in the process, where the beneficiary, or foreign fiancé(e), attends an in-person interview at the U.S. embassy or consulate in their home country. The reason for the interview is to both verify the legitimacy of the couple’s relationship and confirm eligibility for the K-1 visa. Once the National Visa Center (NVC) forwards the approved I-129F petition to the U.S. embassy or consulate, the applicant will receive instructions on how to schedule the interview. 

The beneficiary will be required to bring the gathered documents with them to the interview. List of required documents are listed under section “Required Documentation for K-1 Visa.”

Eligibility Requirements For K-1 Visa 

To qualify for a K1 Visa, it is important that you (the petitioner) and your fiancé(e) meet the following eligibility criteria: 

  1.  The Petitioner MUST be a U.S. Citizen. Green card holders or permanent residents will not be able to petition for their foreigner fiancé(e).Must intend to marry the foreign fiancé(e) within 90 days of their entry to the U.S.
  2. Must Intend to Marry within 90 Days of entry. 
  3. The beneficiary MUST be Admissible to the U.S. This means that the foreign fiancé(e) cannot have any criminal convictions, health-related issues, 0r prior immigration violations that would make them inadmissible. This is why a medical examination report and police clearance certificates are required during the K-1 application process. 
  4. The petitioning U.S. citizen MUST meet financial requirements to support the foreign fiancé(e) through the Affidavit of Support (Form I-134). This means that the petitioner must prove they can financially support the foreign fiancé(e). 
  5. The petitioning U.S. citizen must have been physically present in the U.S. for at least 6 months prior to filing (in most cases).
  6. The couple must be Legally Able to Marry. This means that neither the petitioner or the beneficiary are not currently married to someone else.
  7. The couple MUST have met in-person at least once within the past two years (with certain exceptions).
  8.  The relationship must be genuine, not solely for immigration purposes. This is why the K-1 visa process requires extensive proof of the relationship to ensure its authenticity.
